Personal Property: A 10% Buyer's Premium & 5.5% Sales Tax will be added to the highest bid to arrive at the total purchase price. Payment in full is required before purchases may be removed from the premises. Payment options: Cash, check (payable to Fowler Auction) or credit card on file (or other card).
All sales are subject to Alabama sales tax, unless you have an Alabama sales tax exemption number. Any other state’s farm certificates are not honored in the state of Alabama, therefore, they are not honored here. Only current “For Resale” certificates (from any state) will be honored. A sales tax number must be included in your Fowler Auction ONLINE Bidding Profile and a certificate MUST be presented to Fowler Auction for our records.
** All personal property is sold 'AS-IS, Where-Is' Condition, and ALL SALES ARE FINAL. Property is open to thorough public inspection on inspection date. It is each Bidder's responsibility to determine condition, age, genuineness, value or any other qualifying factor. Fowler Auction & Real Estate Services, Inc. may attempt to describe the merchandise in advertising and on the internet, but makes no representations or guarantees. In no event shall Fowler Auction & Real Estate Services, Inc. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidders who bid online and do not attend the preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is STILL each Bidder's responsibility to determine condition, age, genuineness, value or any other qualifying factor. Fowler Auction & Real Estate Services, Inc. will attempt to describe in detail each item and any pertinent information about it. Fowler Auction & Real Estate Services, Inc. will not be responsible for any errors or omissions in the description of the merchandise. Each Bidder agrees that everything is sold AS IS and that he/she MAY NOT return any item he/she purchases.

Each Bidder is responsible for knowing which item is being bid on. If the Bidder is unsure, he/she should inquire or not bid. When becoming the winning Bidder at auction, you have affected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor a mistake.
Information in brochures, catalogs and/or other advertisements are from sources believed to be reliable; however, prospective purchasers are STRONGLY urged to inspect the inventory or property to satisfy themselves as to condition, model, manufacturer, year, features, mileage, survey, acres, etc. Neither the Auctioneer nor our clients make any guarantees and are not responsible for listing or advertising inaccuracies or discrepancies.
If for any reason the Buyer fails to make full payment in accordance with the terms above, the Buyer will be liable for the unpaid balance still due and owing, plus interest in the amount of twelve percent (12%) per annum from the auction date and reasonable attorney fees and expenses for collection as a result of said default.
THIS AUCTION FEATURES AN AUTO BID EXTEND
AUCTION END TIMES: Fowler Auction's Online Auctions are timed events and all bidding will close at specified time. Fowler's Online Auctions also have an auto extend feature. When a bid is placed in the final 3 minutes of bidding, the auction bidding will be automatically extended 3 minutes from the time the bid was placed (i.e., if an auction scheduled to close at 6:00 receives a bid at 5:59, the close time will automatically extend to 6:02. The auto extend feature remains active until no further bids are received within a 3 minute time frame.
A credit card is required to register to participate in this auction. Buyer has the option to pay with cash, check or credit card. However, if funds are not provided to Fowler Auction & Real Estate Service, Inc. within 24 hours of auction end time, the credit card used to register for this auction will be charged for the entire invoice total.
SERVER, SOFTWARE TECHNICAL OR INTERNET ISSUES: In the event there are technical difficulties related to the server, software, or any other online auction-related technologies, reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR FOWLER AUCTION & REAL ESTATE SERVICE, INC. SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by Fowler Auction & Real Estate Service, Inc.

Bidder responsibilities include, but are not limited to: Bidders agree to keep his/her username and password confidential as each individual is responsible for ANY and ALL activity involving his/her account. If your USER NAME is offensive to Fowler Auction & Real Estate Service, Inc., then we reserve the right to terminate your bidding.
When using the web site you must obey any and all local state and federal laws. Violations will result in termination of web site use privileges. Auction company employees and/or auction company may bid on this auction. We gather aggregate information from this web site which may include but is not limited to: number of page visitors, most visited pages, any and all correspondence.
DEFAULT: If purchases are not settled by the specified closing/pick up day, it will be considered in default. Upon default the bidder will be black listed/blocked from bidding on Fowler Auction & Real Estate Service, Inc.'s auctions, as well as MarkNet Alliance auctions and may be charged 10% of bid price or $500, whichever is greater. All defaulted items may be offered to the next highest qualified bidder at the discretion of Fowler Auction & Real Estate Service, Inc.
Any dispute between Fowler Auction & Real Estate Service, Inc., its Agents or Representatives, and the Buyer(s) will be tried in a court of jurisdiction in Madison County, Alabama (or county designated by Fowler Auction). By bidding on the property, buyer agrees to all terms and conditions set forth.
Buyer and or Bidder agrees to hold harmless and indemnify Fowler Auction & Real Estate Service, Inc. and its Agents and its Representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc.
