Internet Bidder Terms: 10% Buyer's Premium. Certified funds (including cashier's check) must be received by our office no later than Tuesday, May 12th, 2020 at 12 Noon, CDT. If a credit card is the preferred form of payment, the Internet Winner's card will be charged for the purchase (in its entirety) on auction day. We accept Visa, MasterCard & Discover.
Registered Internet Bidders will be required to place their credit card number for pre-approval with the auction company. Unless prior payment arrangements are made through the financial office of Fowler Auction, all successful bids will be charged to the submitted credit card no later than Tuesday, May 12th, at 12 Noon.
A note to Consignors: Titles are required to sell vehicles & most trailers. Titles MUST be presented with vehicle at check-in. Item will be removed from the auction if the title is not in our office 48 hours prior to auction start time.
Consignors: Any item sold under $100.00 will automatically be sold Absolute.
If you wish to have a reserve price, you must be present at the time of auction; otherwise, the item(s) will be sold absolute.
All sales are subject to Alabama sales tax, unless you have a sales tax exemption number. A sales tax certificate MUST be presented day of sale or before payment is received.
Vehicle titles will be processed and mailed to Buyers after auction. Checks must be from the individual or company as registered.
ALL PURCHASED VEHICLES WILL INCUR A VEHICLE PROCESSING FEE (INCLUDING DEALERS). ALABAMA RESIDENTS WILL INCUR a $41.50 FOR TITLE APPLICATION & PROCESSING FEE. ALL OTHER STATES & DEALERS WILL INCUR A $25.00 VEHICLE PROCESSING FEE.
NOTE TO DEALERS: Fowler Auction MUST have a copy of your dealer's license before the payment process is completed. Faxed and email copies are acceptible.
SERVER, SOFTWARE TECHNICAL OR INTERNET ISSUES: In the event there are technical difficulties related to the server, software, or any other online auction-related technologies, Fowler Auction reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR FOWLER AUCTION & REAL ESTATE SERVICE, INC. SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by Fowler Auction & Real Estate Service, Inc.

Bidder Verification: The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, Fowler Auction & Real Estate Service, Inc. will reject the registration, and bidding activity will be terminated. The Seller and Fowler Auction & Real Estate Service, Inc. reserve the right to preclude any person from bidding if there is any question as to the person's credentials, mental fitness, etc.
Bidder responsibilities include, but are not limited to: Bidders agree to keep his/her username and password confidential as each individual is responsible for ANY and ALL activity involving his/her account. If your USER NAME is offensive to Fowler Auction & Real Estate Service, Inc., then we reserve the right to terminate your bidding.

DEFAULT: If purchases are not settled by the specified pick up day, it will be considered in default. Upon default the bidder will be black listed/blocked from bidding on Fowler Auction & Real Estate Service, Inc.'s auctions, as well as MarkNet Alliance auctions and may be charged 10% of bid price or $500, whichever is greater. All defaulted items may be offered to the next highest qualified bidder at the discretion of Fowler Auction & Real Estate Service, Inc.
Any dispute between Fowler Auction & Real Estate Service, Inc., its Agents or Representatives, and the Buyer(s) will be tried in a court of jurisdiction in Madison County, Alabama (or county designated by Fowler Auction). By bidding on the property, buyer agrees to all terms and conditions set forth.
We do assist buyer in loading equipment. Buyer is responsible for his own items. Buyer is responsible for securing his own load. Fowler Auction is not responsible for any damage incurred to equipment or vehicles while loading.
Buyer and or Bidder agrees to hold harmless and indemnify Fowler Auction & Real Estate Service, Inc. and its Agents and its Representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc.
All items must be removed from auction yard no later than March 7th, 2020. Items left on the auction yard after March 7th, 2020 will be re-tagged and sold at our next consignment auction.
